1. Acceptance of Terms

By accessing or using the Tothara platform ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service, including landlords, property managers, property owners, tenants, and guests.

2. Description of Service

Tothara is a rental management platform designed for property management companies and landlords. The Service provides tools for managing short-term, mid-term, long-term, and recurring rental strategies, including property listings, tenant and guest management, maintenance tracking, payment processing, and related communications.

3. Accounts and Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. SMS / Text Message Communications and Consent

By creating an account and providing a phone number, you expressly consent to receive text messages (SMS and MMS) from Tothara at the phone number you provide. These messages may include, but are not limited to:

  • Account verification and security codes
  • Booking confirmations, updates, and reminders
  • Maintenance request status updates
  • Payment notifications and reminders
  • Lease and tenancy alerts
  • Platform announcements and service updates
  • Promotional and marketing messages related to Tothara features and offers

Message frequency will vary based on your account activity and preferences. Standard message and data rates may apply depending on your mobile carrier and plan.

Opt-Out: You may opt out of marketing SMS messages at any time by replying STOP to any text message you receive from us. After opting out, you will receive a one-time confirmation message. Transactional and account-related messages (such as security codes and critical account notices) may continue as necessary for the operation of your account.

You represent that you are the account holder or have the account holder's permission for the phone number provided. Tothara is not liable for any delays or failures in the delivery of SMS messages, as delivery is subject to effective transmission by your mobile carrier.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Transmit any harmful, offensive, or fraudulent content
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems

6. Payment and Billing

Subscription fees for the Service are billed in advance on a monthly basis. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. Tothara reserves the right to change pricing with reasonable advance notice to active subscribers.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Tothara and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TOTHARA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOTHARA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the date at the top of this page and, where appropriate, by sending you an email or SMS notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Tothara is incorporated, without regard to conflict of law principles.
